"Company," "we," "us," or "our" means Functional Medicine Fast Track LLC, 870 N Miramar Avenue #445, Indialantic, FL 32903.
"Program" means any coaching, training, clinical mentorship, platform access, or related service offered by FMFT, including but not limited to the FMFT system, Scalerize.ai, Thrive Nine, and associated member resources.
"Practitioner," "you," or "your" means the licensed healthcare professional who has enrolled in, or is seeking to enrol in, an FMFT program.
"Platform" means any software, application, portal, or digital tool made available to Practitioners as part of the Program, including Scalerize.ai and the Thrive Nine assessment system.
"Content" means any educational materials, clinical frameworks, video scripts, marketing assets, assessment tools, or other intellectual property made available through the Program.
"Clients" means the end patients or clients enrolled by a Practitioner in the Practitioner's own functional medicine practice using the FMFT system. Clients are not party to these Terms and have no relationship with FMFT.
The FMFT Program is available to licensed healthcare professionals only. By enrolling, you represent and warrant that:
FMFT reserves the right to verify eligibility at any time and to suspend or terminate access if eligibility requirements are not met.
FMFT provides licensed healthcare professionals with a business and clinical education system. This includes:
The Program is designed to support practitioners in building or scaling a functional medicine practice. FMFT does not guarantee specific business, clinical, or financial outcomes. All program content is educational in nature.
FMFT's Program teaches clinical and business frameworks. It does not constitute the practice of medicine, clinical supervision, or the provision of medical advice to any patient. Practitioners remain solely responsible for all clinical decisions made in their own practice.
Certain platform features, including lab interpretation support and report generation within the Thrive Nine system, are assisted by artificial intelligence tools. All AI-generated outputs are educational and informational in nature. Practitioners are responsible for independently evaluating any AI-assisted content before applying it in their practice.
All content delivered through the FMFT Program — including clinical frameworks, case review feedback, supplement guidance, lab interpretation frameworks, and protocol structures — is provided for educational and business training purposes only.
FMFT's case review and mentorship does not constitute:
You remain fully responsible for all clinical decisions made in your practice. You agree to practice within the scope of your license and in compliance with all applicable laws, regulations, and professional standards in your jurisdiction.
Clients enrolled in a Practitioner's functional medicine practice using the FMFT system are the Practitioner's clients — not FMFT's. FMFT has no direct relationship with, and no responsibility to, any client of a Practitioner.
As a Practitioner, you are solely responsible for:
FMFT does not provide clinical advice, program updates, or status information to any Practitioner's clients. If a client contacts FMFT directly, FMFT will direct them back to their Practitioner and is under no obligation to respond to client inquiries on a Practitioner's behalf.
You agree to communicate clearly to your clients that:
Failure to manage client communications appropriately — including clients contacting FMFT seeking clinical advice or progress updates — is a breach of these Terms and may result in suspension or termination of program access.
Any income figures, revenue outcomes, or practitioner results referenced on the FMFT website, in marketing materials, or in program content are illustrative and reflect individual practitioners who fully implemented the FMFT system.
Individual results vary and are not guaranteed. Outcomes depend on credential, niche, market conditions, effort, implementation quality, and other factors outside FMFT's control.
Nothing in the Program or on our website constitutes a guarantee of income, business success, or clinical outcomes. You acknowledge that building a functional medicine practice requires significant personal effort, commitment, and ongoing implementation.
Program fees are due as specified at the time of enrollment. By enrolling, you authorize FMFT (or its payment processors) to charge all fees in accordance with your selected payment plan.
Subscription programs are billed in advance on a recurring basis (monthly or otherwise as specified). Your subscription renews automatically until cancelled. Cancellation stops future charges but does not retroactively apply to the current billing period unless required by law.
You are responsible for maintaining accurate and current billing information. Failed payments may result in suspension or termination of program access.
A refund may be requested in writing within seven (7) days of enrollment and will be granted only if, at the time of the request, you have not accessed the Program — meaning:
Once you have accessed the Program in any meaningful way, all fees are fully earned and non-refundable. You remain responsible for all outstanding Program payments regardless of your participation level or decision to withdraw.
All refund requests must be submitted in writing to [email protected] within the 7-day window. Requests submitted outside that window or where access conditions have not been met will not be approved.
Initiating a chargeback or payment dispute without first contacting FMFT to resolve the matter is a breach of these Terms. FMFT reserves the right to suspend or terminate program access upon initiation of a dispute and to recover any associated fees or costs.
All Program content — including but not limited to clinical frameworks, Thrive Nine assessment tools, Scalerize.ai funnels, training materials, video scripts, marketing assets, case review methodologies, and supplement protocols — is the exclusive intellectual property of Functional Medicine Fast Track LLC.
By enrolling, you are granted a limited, non-exclusive, non-transferable license to use Program content solely for the purpose of operating your own licensed healthcare practice. You may not:
Your license to use Program content terminates upon cancellation or termination of your Program enrollment.
Participation in any FMFT group calls, community forums, or Zendesk support channels is a privilege, not a right. FMFT reserves the right to remove any Practitioner from community access for conduct that includes but is not limited to:
Removal from community access does not constitute a basis for a refund and does not terminate payment obligations.
FMFT will use reasonable efforts to maintain platform availability and deliver program content as described at the time of enrollment. However, FMFT does not guarantee uninterrupted access and reserves the right to:
Program delivery formats (including group call schedules, mentorship structures, and platform tools) may change over time. FMFT will notify enrolled Practitioners of material changes. Continued enrollment following notice of a change constitutes acceptance of the updated delivery format.
Certain program components — including case review sessions, clinical frameworks, and strategic business content — may include confidential information. You agree to:
To the fullest extent permitted by law, FMFT's total liability to you for any claim arising out of or related to these Terms or the Program shall not exceed the total fees paid by you to FMFT in the twelve (12) months preceding the claim.
FMFT is not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost patients, loss of business opportunity, or professional license consequences arising from your participation in or use of the Program.
You acknowledge that clinical and business outcomes depend on your own implementation, judgement, and effort, and that FMFT cannot guarantee results.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions.
Any dispute arising out of or related to these Terms or the Program shall first be submitted to FMFT's support team for resolution. If the dispute is not resolved informally within thirty (30) days, it shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in Brevard County, Florida.
The maximum remedy available through arbitration is a full refund of fees paid to date. You waive any right to a jury trial or to participate in a class action lawsuit in connection with any dispute relating to these Terms.
FMFT reserves the right to update these Terms at any time. We will notify enrolled Practitioners of material changes via email or platform notification. Continued use of the Program following notice of updated Terms constitutes your acceptance of the changes.
The current version of these Terms is always available at www.functionalmedicinefasttrack.com/terms.
These Terms, together with the FMFT Privacy Policy and any executed Master Services Agreement, constitute the entire agreement between you and FMFT with respect to the Program and supersede all prior agreements, representations, or understandings, whether written or oral.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
